1. USER ACCEPTANCE OF TERMS

By purchasing, downloading, installing, or using TrainzHub assets, you acknowledge that you have read, understood, and agree to follow these Terms and Conditions.

TrainzHub reserves the right to update or modify these terms at any time. Any important changes will be published on the TrainzHub website and will become effective from the date of publication. Continued use of the assets after changes have been made means that you accept the updated terms.

2. LIMITED LICENSE

TrainzHub grants you a limited, non-exclusive, and non-transferable license to install and use purchased assets only for personal use within the intended software environment.

This license applies to the asset files, updates, patches, and related content provided by TrainzHub.

You may not copy, duplicate, redistribute, extract, modify, reverse-engineer, or use any part of the assets for any purpose other than their intended use.

3. OWNERSHIP AND COPYRIGHT

All TrainzHub assets, including models, textures, scripts, sounds, animations, documentation, and any related files, remain the exclusive property of TrainzHub unless otherwise stated.

Purchasing or downloading an asset grants you permission to use it, but does not provide ownership rights.

All assets are protected by applicable copyright laws and international intellectual property regulations.

Unauthorized use, modification, reproduction, or distribution of TrainzHub content may result in legal action.

4. NO SALE OR TRANSFER

TrainzHub assets and licenses may not be sold, transferred, shared, traded, resold, or included in other packages without prior written permission.

You may not upload, distribute, or make these files available to third parties through any website, server, or other platform.

Any unauthorized transfer or redistribution of TrainzHub assets is strictly prohibited.

5. LICENSE RESTRICTIONS

(d) Sell, rent, sublicense, trade, or transfer the assets or any copies of them.

(e) Reverse-engineer, decompile, extract source data, modify, disassemble, or create derivative versions of the assets, except where such actions are explicitly permitted by law.

(f) Remove, disable, or bypass any copyright notices, protection systems, labels, or other ownership information included with the assets.

(g) Export, re-upload, or redistribute the assets in violation of applicable laws or regulations.

(h) Create unauthorized tools, files, or modifications that replicate, replace, or interfere with the functionality of the assets.

(i) Use any included editor or modification tools to create content that violates these terms or infringes on third-party rights.

(j) Modify executable files or protected components included with the assets.

(k) Use the assets to create illegal, harmful, offensive, defamatory, or privacy-invading content.

(l) Use TrainzHub trademarks, copyrights, or intellectual property without prior permission.

Any user-created modifications or content made using permitted tools remain the responsibility of the creator. TrainzHub is not responsible for third-party claims resulting from unauthorized use.

Users must also follow any included documentation, instructions, safety information, or usage guidelines provided with the assets.

6. REFUNDS AND RETURNS

TrainzHub products are digital downloadable items intended for use within the supported software environment.

Because digital products are delivered electronically and cannot be physically returned, purchases are generally non-refundable after delivery.

By completing a purchase, you acknowledge that the product is a digital item and agree to these terms.

7. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

TrainzHub assets are provided on an “as available” and “as is” basis.

8. INDEMNIFICATION

TrainzHub products may be accessible worldwide. However, TrainzHub does not guarantee that all assets are suitable or legally available for use in every country or region.

Users accessing TrainzHub products from outside the country of operation are responsible for complying with their local laws and regulations.

Any use of TrainzHub assets where such content is restricted or prohibited by law is the responsibility of the user.

10. TERMINATION OF LICENSE AND CONTINUATION OF TERMS

This Agreement remains valid until terminated by either party.

You may stop using TrainzHub assets at any time by discontinuing their use. Termination does not entitle you to a refund for payments already completed, except where required by applicable law.

TrainzHub may terminate this license immediately if you violate any part of these Terms and Conditions.

After termination, you must stop using the assets and remove or delete all copies in your possession.

Any sections relating to ownership, restrictions, liability, intellectual property, and other provisions that are intended to remain valid will continue to apply after termination.

11. LEGAL REMEDIES

You acknowledge that unauthorized use, copying, modification, or distribution of TrainzHub assets may cause significant harm that cannot always be compensated by financial damages alone.

Therefore, TrainzHub reserves the right to seek appropriate legal remedies, including court orders or other actions permitted by applicable law, to protect its intellectual property and rights.

12. GENERAL TERMS

These Terms and Conditions represent the complete agreement between you and TrainzHub regarding the use of its assets and replace any previous agreements or understandings relating to the same subject.

TrainzHub reserves the right to update or modify these terms when necessary. Changes will become effective when published.

If any part of these Terms is found to be invalid or unenforceable, the remaining sections will continue to remain valid. Any invalid provision will be replaced with a valid term that most closely reflects the original intention.

Failure by TrainzHub to enforce any part of these Terms does not mean that TrainzHub gives up its right to enforce that provision in the future.

You may not transfer, assign, or sublicense your rights under this Agreement without prior written permission from TrainzHub.

TrainzHub may transfer or assign these Terms, fully or partially, if required for business or legal purposes.

TrainzHub is not responsible for delays, interruptions, or failures caused by circumstances outside of its reasonable control, including but not limited to technical failures, internet outages, natural events, government actions, service interruptions, security incidents, or other unforeseen events.

By purchasing, downloading, or using TrainzHub assets, you confirm that you have read, understood, and agreed to these End User License Terms.
